1. Introduction
Nail Delivery Express Corp. (“we”, “our” or “us”) values the privacy and protection of the personal data of our users.

By accessing, registering, or using the Platform, the user declares that they have read, understood, and fully agree with this Privacy Policy, as well as with the processing of their personal data in accordance with applicable legislation, including, where relevant, the laws of the State of Florida, the Brazilian General Data Protection Law (LGPD), and the General Data Protection Regulation (GDPR – European Union).

• Identification documents and professional license (for Professionals/Nail Technicians);

• Access logs, session data, and Platform usage;
• Cookies and similar technologies.
3.Use of Camera and Media
The Nail Delivery Express application may request access to the device’s camera and media files for the following purposes:
• Allow users (Clients and Professionals) to upload profile photos;
• Allow Professionals to upload photos of their work (portfolio);
• Enable sharing of images related to services, bookings, or communication within the Platform;
• Support identity verification and security procedures when applicable;
• Access to camera and media (only when explicitly authorized by the user).
The camera is only accessed when the user explicitly chooses to use features that require it.
Nail Delivery Express does not access the camera in the background, nor does it record or capture images or videos without the user’s knowledge.
Images and media files are stored securely and are only shared within the Platform according to user actions and permissions.
Users may deny or revoke camera permissions at any time through their device settings, although some features of the Platform may become unavailable.
4. Purposes of Data Processing
The personal data collected may be used for the following purposes:
• Enable the operation of the Platform and the intermediation between Clients and Professionals;
• Process bookings, payments, cancellations, and refunds;
• Verify identity, licenses, and compliance of Professionals;
• Send operational communications, notifications, and updates;
• Send promotional communications, when authorized;
• Ensure security, fraud prevention, and legal compliance;
• Improve features, performance, and user experience.
5.Data Sharing
Personal data may be shared exclusively in the following cases:
• With payment processors and financial services (e.g., Stripe, PayPal or similar);
• With public, regulatory, or judicial authorities when required by law;
• With insurers, background check partners, or compliance providers;
• With technological and operational service providers that assist in the functioning of the Platform, always under confidentiality obligations.
Nail Delivery Express does not sell, rent, or commercialize personal data.
6.Data Retention
Personal data will be retained while the account is active and for the period necessary to comply with legal, tax, and regulatory obligations, generally between 5 (five) and 7 (seven) years for financial and contractual data. After this period, the data may be deleted or anonymized, as permitted by applicable law.

16.Misuse of Data by Independent Professionals
Nail Delivery Express acts solely as a technological intermediary and does not control actions performed by independent Professionals outside the Platform.
Nail is not responsible for any unauthorized, improper, or illegal use of personal data by Professionals after legitimate access to information through the Platform, including external contacts, personal storage, sharing, or use for unauthorized purposes.
Such acts are the sole responsibility of the Professional.
17.Communications Made Within the Platform
The Platform may record, store, and analyze communications made within the application, including messages, calls, requests, confirmations, and cancellations, exclusively for purposes of:
• Security;
• Fraud prevention;
• Dispute resolution;
• User support;
• Legal compliance;
• Service improvement.
Nail is not responsible for communications made outside the Platform.
18.Automated Processes and Algorithmic Criteria
The Platform may use automated systems and algorithmic criteria for:
• Fraud prevention;
• Compliance verification;
• Profile ranking and visibility;
• Account control, limitation, or termination;
• Improving the user experience.
19.Data Deletion and Legal Obligations
A request for deletion of personal data does not eliminate legal, contractual, tax, or financial obligations, nor does it prevent the retention of records necessary for:
• Legal compliance;
• Audits;
• Fraud prevention;
• Regular exercise of Nail Delivery Express’s rights.
20.Limitation of Technological Liability and Force Majeure
Nail Delivery Express is not responsible for failures, unavailability, or incidents resulting from factors beyond its reasonable control, including:
• Third-party service failures;
• Sophisticated cyberattacks;
• Infrastructure interruptions;
• Force majeure events.
21.User Responsibility
The user is responsible for the accuracy of the information provided, for protecting their credentials, and for all activities carried out through their account.
22.Guest Access (“Guest Mode”)
The Platform may allow certain users to partially access specific features through a guest access mode (“Guest Mode”), without the need to create a complete account.
In this mode, the user may view certain Platform features, including general information about how the application works, public Professional profiles, portfolios, photos of completed work, and limited service availability.
Guest access may have functional limitations, including, but not limited to, the inability to make bookings, process payments, engage in full communications, or access features exclusively available to registered users.
Nail Delivery Express reserves the right to limit, modify, or discontinue guest access at any time without prior notice.
23.Account Cancellation and Deletion of History
Users may request the cancellation or deletion of their account directly through the Platform, when such functionality is available, or by contacting Nail Delivery Express official support.
Once the account cancellation is confirmed, the user acknowledges and agrees that they may permanently lose access to:
• Service history;
• Payment and transaction history;
• Preferences and settings;
• Communications made within the Platform;
• Benefits, credits, or data associated with the account.
Account deletion may be irreversible, except for data that must be retained for legal, tax, regulatory, fraud prevention, or dispute resolution purposes, in accordance with applicable laws.
The user acknowledges that it is their responsibility to save any relevant information before requesting the permanent cancellation of the account.
24. Data Collected and Specific Purposes of Use
Nail Delivery Express may collect, store, use, and process certain personal and technical data from users for the purpose of enabling the proper operation of the Platform, ensuring operational security, improving user experience, preventing fraud, complying with legal obligations, and providing functionalities related to the services offered through the application.

a) Name and Registration Information
The user’s name may be used for:
* identification within the Platform;
* account creation and management;
* communication between Clients and Professionals;
* issuance of receipts, confirmations, and internal records.
b) Email Address
The email address may be used for:
* account authentication and login;

* appointment confirmations;
* operational communications and support;
* promotional communications and notifications, when authorized by the user.
c) Phone Number
The phone number may be used for:
* communication between Clients and Professionals;
* appointment confirmations and updates;
* security authentication;

* fraud prevention and suspicious activity monitoring.
d) Location Data
The Platform may collect approximate or precise location data in order to:
* identify nearby professionals;
* facilitate appointments and service requests;
* improve user experience and service recommendations;
* support fraud prevention and operational security.
Users may disable location access through their device settings, although certain Platform functionalities may become limited.
e) Photos and Videos Submitted by Users
Photos, videos, and media files submitted by users may be used for:
* profile creation;
* professional portfolios;
* showcasing completed services;
* communication within the Platform;
* identity verification and security purposes, when applicable.
Submitted content remains the responsibility of the user and may be removed in the event of violations of the Terms of Use or applicable laws.
f) Payment Information
When applicable, payment-related information may be processed by secure third-party payment providers such as Stripe, PayPal, or similar services.
Nail Delivery Express does not fully store sensitive credit card information on its own servers.
Payment-related data may be used for:
